2019 CANS Toromont Cat and Battlefield Equipment De-Icer

On Friday April 26, 2019 the CANS Toromont Cat and Battlefield Equipment De-Icer brought out almost 1,800 individuals for an exceptional evening of fine dining, entertainment and networking. Our largest De-Icer crowd to-date, this was the perfect kickoff to the construction season! Held at the Cunard Centre in Halifax, the De-Icer is Nova Scotia’s largest construction networking event.

Guests enjoyed a meal of lobster, a quarter chicken dinner with half rack of ribs, or portobello mushroom as well as sweets, mussels, appetizers and refreshments, while being entertained by musical duo Rowdy Dow. De-Icer attendees also enjoyed shuttle-bus service which transported guests to the Marriott Harbourfront hotel, Barrington Street in downtown Halifax, and the Westin hotel at the end of the evening.

Prompt Payment legislation coming to the Nova Scotia construction industry.

 Halifax, NS – (05/01/2019) The Construction Association of Nova Scotia (CANS) and the Nova Scotia Prompt Payment Coalition are pleased with the Province of Nova Scotia’s decision to amend the existing Builders’ Lien Act to include prompt payment legislation.

“The existing law in Nova Scotia is costly, cumbersome, and inaccessible to many small and medium-sized family-owned companies,” says Duncan Williams, President and CEO of CANS. “It addresses non-payment as opposed to delinquent payment and the lien rights of many in the industry will expire long before they realize they will not get paid.”

“Our province needs a prompt payment solution that works for everyone including employers, contractors, buyers of construction and consumers,” says Tim Houtsma, board member of the Canadian Institute of Steel Construction. “While this serious problem is being felt now in our industry, there is a risk to Nova Scotia’s competitiveness long-term if we do not take action to fix the issue.”

Over the past several years CANS has conducted membership surveys to solicit feedback on prompt payment. In 2018 most members indicated that delayed payments were occurring on almost all of their jobs, which increased the cost of doing businesses. If proper legal framework was in place to combat delinquent payments, their organizations would be in a better position to purchase equipment, increase the use of apprentices and hire more people.

On Thursday, April 11, Bill 119 passed its third reading at the Nova Scotian legislature. The bill will carry the new name of Builders’ Lien and Prompt Payment Act, and will establish a system of requirements to ensure timely payment in the construction industry. Stakeholder consultations are expected to take place over the summer.

Duncan Williams says “The Act will set out minimum payment requirements and will have a systematic approach to how money will be released with rights and responsibilities set forth for all parties to a construction project.”

Our coalition believes that these changes will improve the movement of money in our economy, increase fairness and transparency, efficiency and productivity, and lower the overall cost of construction projects.

NS Prompt Payment legislation

Dear CANS member,

I am writing to give you an update on the progress that has been made on Prompt Payment legislation over the past few weeks. The first reading of Bill 119, named the Builders Lien and Prompt Payment Act, passed on March 15, 2019. Rather than introduce entirely new legislation, Prompt Payment was added on to the existing Builder’s Lien Act. You can view Bill 119 as introduced by clicking HERE.  To align with similar initiatives across Canada, we have recommended that the Province of Nova Scotia adopt very similar language as has been used in Ontario.

On Monday, April 8th Bill 119 was reviewed by the Law Amendments Committee. Representations were made by stakeholders, including CANS. The Committee passed a motion referring the Bill back to a Committee of the Whole. While some suggested tweaks and additions were made by those presenting, it is CANS position that any required adjustments can be accommodated in regulation. We therefore expect that Bill 119 will pass third reading before the House rises at the end of April.

We anticipate stakeholder consultations to take place over the summer with the Bill being proclaimed in the fall of 2019.

On March 26, the Province introduced the 2019-20 Nova Scotia Budget.

  • Our population is at a historic high. For the first time in a generation, population growth is nearing the national average.
  • Employment grew, on average in 2018, at the most substantial annual rate since 2004. As of February 2019 (which had the lowest unemployment rate on record since 1976 when the current Labour Force Survey was first published), Nova Scotia had eight straight months of employment gains.
  • For the first time in three decades, more youth are moving to Nova Scotia than are moving out.
  • Disclosed raised venture capital increased by 347 per cent from 2013 to 2018, a higher growth rate than the national average.
  • Record numbers of new immigrants have made Nova Scotia home, and more international students are choosing to stay than at any time in our history.
  • Exports have diversified to new destinations and products. Non-energy exports have risen 40.4 per cent (2010–2017), enough to offset the decline in oil and gas, while exports to the growing Chinese market have increased by 118 per cent (since 2014).
  • Government has balanced the budget since 2016. The net debt to GDP ratio continues to decline. As a result of strong fiscal management, Nova Scotia has among the top four credit ratings in Canada.

ECONOMIC GROWTH GOALS

  • $500,000 increase for incubators and accelerators that support start-up companies, for a total of $1.5 million
  • $3 million as part of the three-year Building Tomorrow Fund to promote innovation and new product development for fisheries, aquaculture, and agriculture producers
  • $850,000 additional funding for NSBI to expand and enhance export development programming that supports Nova Scotia businesses, including the Export Growth Program
  • $1 million to continue to offer ACCESS-Ability grants for businesses to make accessibility-related improvements and work toward a barrier-free province
  • Within its existing budget, the Nova Scotia Apprenticeship Agency will increase its START Program grant by $5,000 to employers who hire apprentices from underrepresented groups, bringing the total amount available to $30,000 over the term of an apprentice’s training
  • $350,000 provided to Clean Foundation to support 73 internships across the province this summer to do research, manage events, develop leadership skills and innovative ideas, and take on projects that help the environment
  • $800,000 to support the on-going operation of post-secondary sandboxes
  • $200,000 increase for the Productivity and Innovation Voucher program to connect Nova Scotia companies with local universities to drive innovation and global competitiveness
  • $3 million to create the Venture Capital Tax Credit to encourage Nova Scotian businesses and individuals to support funds that invest in new and growing businesses in the province
  • $12 million for the Innovation Equity Tax Credit to allow individuals and Nova Scotia companies to make direct equity investments in small and medium-sized Nova Scotia businesses
  • $2.5 million increase to Develop Nova Scotia’s budget to deliver on its new provincial mandate, including managing a plan to deliver better access to high-speed internet in underserviced areas
  • $5 million to double the Innovation Rebate Program to encourage private sector investments in innovation and productivity projects
  • $60 million for an accelerated capital cost allowance tax incentive to allow Nova Scotia businesses to recover the cost of capital investments more quickly, which will help them remain competitive with the United States
  • $2 million increase for Invest Nova Scotia to fund projects that will increase economic competitiveness and productivity in sectors and communities, for a total of $6 million

 GOVERNANCE AND SUSTAINABILITY

  • 4th year of balanced budgets
  • Projected $33.6 million surplus
  • “The One Nova Scotia Commission set a goal of 30 per cent net debt to GDP ratio by 2024. We are trending in the right direction and moving toward that goal. We reduced our ratio from 38.2 per cent in March 2014 to 35 per cent last year, and now project it to fall to 33.8 per cent by the end of 2019–20.” (Budget Address 2019-20)
  • $7 million in provincial contributions for green infrastructure funding to help transition communities to a clean economy as part of the Investing in Canada Infrastructure Plan
