Membership Services Agreement
The Construction Association of Nova Scotia’s (CANS) services including, but not limited to, the newsletter, plans room, website, membership directory and all other services are provided to members for information purposes only. CANS makes no warranties or representations that any of the information or services provided by CANS will meet any specific requirements, be error-free, uninterrupted, complete, accurate or timely.
All CANS services are intended for the private use of only CANS member companies and their staff. Any commercial or other unauthorized use of the information provided by CANS is forbidden. CANS user IDs/passwords and plans room access cards are provided to member companies for the sole use of its registered member company representative(s). The company agrees to take responsibility for the actions of its representative(s) using CANS services and to ensure that the representative(s) comply with the terms of this Agreement.
Any information provided by CANS is presented as a service to our members and in some instances the public. Attempts to modify any information stored on the CANS website or use this information for other than its intended purposes are strictly prohibited. Any commercial or other unauthorized use of the information contained therein, including, and not limited to, reverse engineering of drawings, in part or in whole, is expressly forbidden.
CANS information services are created in and controlled by CANS. As such, this Agreement shall be governed by the laws of the Province of Nova Scotia and the laws of Canada applicable therein.
We reserve the right to make changes to the information services provided and to this member services agreement, disclaimers and conditions at any time without notice.
Disclaimer
CANS makes no warranties or representations, expressed or implied, including without limitation conditions of merchantability or fitness for a particular purpose of the information and materials provided by CANS. The CANS website contains information provided to CANS by third-party sources. Efforts have been made to ensure the accuracy of the information provided. No warranty expressed or implied is offered as to the accuracy of the information available. Please refer to tender information, plans, specifications and addenda maintained with the plan issuer or contracting authority.
Intellectual Property
Material such as engineering drawings/plans, specifications and addenda, training and course material and other documents may be provided to CANS for use by authorized users. Unless as otherwise noted such materials may be the subject of copyright ownership. Infringement of copyright and other intellectual property rights is strictly prohibited.
Limitations
CANS, its members, directors, officers, employees, agents and contractors shall not be liable for any damage (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials and information provided on the CANS website.
Revisions
Every effort is made to provide accurate information. However, pages contained on the website (text, graphics, tables, audio and video) may contain technical inaccuracies and typographical errors. CANS accepts no responsibility for maintaining the information in these pages and ensuring that the information contained herein is accurate, complete or up to date. CANS may change the materials contained on this website at any time without notice.

Any links in this website are for convenience only. CANS does not endorse third party products, services or information.
Privacy
All personal information collected at this site will be kept strictly confidential unless otherwise specified. In accordance with the Canadian Construction Association’s (CCA) Memorandum of Understanding, CANS will provide our integrated member email list, as required, to be compliant with CCA by-law notifications. CANS also agrees that CCA may communicate directly with CANS members (full members only), only in instances where it is required for legal compliance purposes. Personal information will not be sold, or otherwise disclosed unless consent has been provided. This is in keeping with CANS Policy for Protection of Personal Information and the Personal Information Protections and Electronic Documents Act (PIPEDA) of May 2019.
Misuse
Exchange, circulation or misuse of user ids and passwords is strictly prohibited. Inappropriate use of CANS services, damage to or theft of CANS property may result in suspension or termination of a company’s membership, non-member access, and individual privileges of access and may result in immediate suspension of all CANS services without notice.
In consideration for using CANS services and information contained therein the company/user hereby releases CANS, its members, directors, employees, contractors and agents from any and all claims arising from the use or inability to use CANS services or any information contained therein and agrees to indemnify CANS, its members, directors, employees, contractors and agents from any and all claims made, or losses suffered, by any person for any reason or any use whatsoever (whether or not improper or unauthorized) of CANS services and information contained therein.
Payment Policies
Credit privileges will be extended to member companies and invited guests in good standing and whose accounts are up to date. Non-members are to pay for documents or services at time of purchase by credit card.
Payments are due upon receipt of invoice. Companies having accounts over 90 days in arrears will have credit privileges suspended until the account has been settled.
Industry Education & Training Program course registrations and CANS Event ticket purchases are to be made in advance.
Refund Policy
Documents may be returned if unused and in original condition within 30 days of purchase and will be refunded for the purchase price.
Cancellation of Industry Education & Training Program course registrations or CANS Event ticket purchases must be received no later than 10 working days prior to the event date to be eligible for a 75% refund of fees paid. No refunds will be issued after this date.
Membership dues and drawing orders are non-refundable.
